Terms and Conditions for Ad Hoc Childcare
as of June 2025
These terms and conditions ("Terms") apply to all agreements and order confirmations entered into by The Nanny Agency ("The Nanny Agency") with any client ("Client") for the provision of ad hoc private childcare ("Childcare"). The individual providing Childcare is referred to as the "Babysitter."
1. Order Confirmation
1.1 All details for Childcare, including the date, start and end time, number of children, location, and hourly rate, are confirmed in writing by The Nanny Agency.
1.2 The Client must provide written consent if the Babysitter is allowed to:
Take children on outings, including by public transport
Administer medication
1.3 Any changes to the agreed time, date, or terms of the booking are not valid unless confirmed in writing by The Nanny Agency.
2. Fees and Payment
2.1 Standard hourly rate (up to 2 children): DKK 313 incl. VAT
2.2 Each additional child: +15% surcharge
2.3 Overtime rate: +15% applies to
All hours worked after 22:00
Weekends from Friday 18:00
2.4 Night rate (00:00–07:00): DKK 470 incl. VAT
2.5 The Nanny Agency Fee:
One-time, non-refundable fee of DKK 600 (incl VAT) if more than 48 hours before the start of the ad hoc booking and DKK 800 (incl VAT) if less than 48 hours before the start of the ad hoc booking
Payable within 5 banking days after contract confirmation
2.6 Billing is calculated per started half hour
2.7 Invoices are issued every 30 days and payable within 5 banking days
2.8 Payments must be made via Wise or to:

2.9 Late payment interest: 4% per commenced month
2.10 Outstanding payments may not exceed DKK 20,000. If this cap is exceeded, and payment is not received within 5 banking days, childcare service will be suspended until payment is settled.
2.11 Booked hours are invoiced in full unless agreed otherwise
2.12 The minimum booking duration is 3 hours unless otherwise agreed in writing with The Nanny Agency.
3. Cancellation
3.1 More than 48 hours’ notice: no charge.
3.2 Less than 48 hours’ notice: full agreed hours invoiced.
3.3 The agency fee is always non-refundable.
4. Modifications After Shift Start
4.1 If a confirmed shift is cancelled or shortened after the Babysitter has arrived, the Client will be invoiced for the full duration of the originally booked hours.
5. Extension of Shift
5.1 If the shift extends by more than 10 minutes beyond the confirmed end time, the Client will be invoiced for the additional time based on the applicable hourly rate, including applicable overtime surcharges.
5.2 If the Client returns later than the agreed end time, the extra time will be invoiced in accordance with the applicable hourly rate, including overtime where relevant. In the case of repeated delays exceeding 10 minutes, invoicing will occur in 30-minute increments.
6. Private Arrangements with Babysitters
6.1 The Client may not privately hire a Babysitter from The Nanny Agency without prior written permission.
6.2 If a Client wishes to rebook a Babysitter for future services, The Nanny Agency must be informed and will coordinate the booking
7. Working Conditions
7.1 The Client must ensure safe and hygienic working conditions, including toilet access and compliance with relevant laws or health regulations.
7.2 The Client must provide relevant information concerning the children’s health and well-being, including allergies, medical needs, dietary restrictions, or other special conditions. Emergency contact details must be provided before the first shift.
7.3 The Babysitter is not obligated to care for sick children unless this has been agreed in advance. The Client must notify The Nanny Agency in writing if any child has become ill before the shift.
7.4 For shifts exceeding 8 consecutive hours, the Client must provide the Babysitter with a minimum 30-minute paid break and access to water and a meal or snack, depending on the time of day.
8. Communication
8.1 Contact numbers of both Babysitter and Client are shared prior to scheduled shifts.
8.2 The Client has full instruction authority during the shift.
9. Babysitter Assignment
9.1 Babysitters are selected by The Nanny Agency based on Client needs and Babysitter qualifications.
9.2 Services are provided exclusively to private individuals.
10. Replacement of Babysitter
10.1 The Nanny Agency may replace a Babysitter due to illness, absence, or similar.
10.2 Replacement must not result in extra cost to the Client.
11. Conduct Policy
11.1 Babysitters must not smoke, vape, drink alcohol, or use drugs while on duty.
12. Insurance and Liability
12.1 Babysitters are covered by occupational injury and liability insurance.
12.2 The Nanny Agency is not liable for cancellations, disruptions, or incorrect information provided by the Babysitter.
12.3 Maximum liability is limited to amounts invoiced under the affected agreement.
12.4 The Nanny Agency is not liable for indirect or consequential losses unless otherwise required by law.
12.5 In case of force majeure (e.g. pandemic, strike, lockdown), all obligations are suspended for the affected period.
12.6 The Nanny Agency and the Babysitter are not liable for damage to the Client’s property or belongings that may occur during a shift, unless caused by gross negligence or intentional misconduct.
13. Criminal Record and Health Declarations
13.1 The Nanny Agency obtains:
A general criminal record certificate
A child-specific criminal record
14. Confidentiality
14.1 All parties are bound to confidentiality regarding any personal or business matters involving The Nanny Agency, the Babysitter, or the Client.
15. Personal Data
15.1 The Nanny Agency is the data controller.

15.8 Clients have rights to access, correct, delete, object, and complain to Datatilsynet (www.datatilsynet.dk)
16. Amendments and Disputes
16.1 Amendments require written confirmation by The Nanny Agency
16.2 Agreements are governed by Danish law
16.3 Disputes must first be resolved amicably within 30 days
16.4 If unresolved, disputes are handled by the court of jurisdiction for The Nanny Agency

Terms and Conditions for Private Childcare

These terms and conditions ("Terms") apply to all agreements and order confirmations entered into by The Nanny Agency ("The Nanny Agency") with any client ("Client") for the provision of private childcare services ("Childcare"). The individual providing Childcare is referred to as the "Babysitter."
1. Order Confirmation
1.1 The scope of services, working hours, responsibilities, location, and pricing are specified in the signed contract (“Contract”) between the Client and The Nanny Agency. Any ongoing childcare agreement is governed by the Contract and these Terms.
1.2 The Client must provide written consent for the Babysitter to:
Take photographs of the children
Take children on outings, including by public transport
Administer medication
1.3 Any changes to the agreed period or terms require a new written confirmation from The Nanny Agency.
1.4 The Client may arrange additional or changed shifts directly with the Babysitter or through The Nanny Agency and confirmed in writing.
1.5 Any changes to the Contract, including shifts, scope, or conditions, are only valid when confirmed in writing by The Nanny Agency. Direct agreements with the Babysitter are not considered binding.
1.6 If the Client has previously given written consent for the Babysitter or The Nanny Agency to take and use photos of the Client’s children, it is the Client’s responsibility to inform The Nanny Agency in writing if this consent is withdrawn. The Nanny Agency will, to the best of its knowledge and ability, remove any previously used photos from social media upon receiving such notice.
2. Fees and Payment
2.1 Standard hourly rate (up to 2 children): DKK 295 incl. VAT
2.2 Each additional child: +15% surcharge
2.3 Overtime rate: +15% applies to
All hours worked after 22:00
Weekends from Friday 18:00
2.4 Night rate (00:00–07:00): DKK 443 incl. VAT
2.5 The Nanny Agency Fee:
One-time, non-refundable fee
Amount based on contract length and admin workload
Payable within 8 banking days after contract confirmation
2.6 Billing is calculated per started half hour

6. Private Arrangements with Babysitters

7. Transport
7.1 If the Babysitter uses a private car for work-related transport, the Client reimburses mileage at SKAT’s tax-free rate.
8. Working Conditions
8.1 The Client must ensure safe and hygienic working conditions, including toilet access and compliance with relevant laws or health regulations.
8.2 The Client must provide relevant information concerning the children’s health and well-being, including allergies, medical needs, dietary restrictions, or other special conditions. Emergency contact details must be provided before the first shift.
8.3 The Babysitter is not obligated to care for sick children unless this has been agreed in advance. The Client must notify The Nanny Agency in writing if any child has become ill before the shift.
8.4 For shifts exceeding 8 consecutive hours, the Client must provide the Babysitter with a minimum 30-minute paid break and access to water and a meal or snack, depending on the time of day.
9. Communication
9.1 Contact numbers of both Babysitter and Client are shared prior to scheduled shifts.
9.2 The Client has full instruction authority during the shift.
10. Ongoing Bookings
10.1 For recurring arrangements, the signed Contract must be returned to The Nanny Agency before the first invoice is due.
10.2 For ongoing Childcare agreements, either party may terminate the agreement with 14 calendar days’ written notice. The notice period starts from the date the written notice is received.
The Nanny Agency reserves the right to terminate the agreement with immediate effect in cases of:
Repeated late or non-payment by the Client
Unsafe or inappropriate working conditions
Disrespectful or inappropriate conduct toward the Babysitter or The Nanny Agency
Any outstanding invoices must be settled before the next shift takes place.
10.3 The first 2 weeks of any ongoing Childcare agreement are considered a trial period. During this time, either party may terminate the agreement with 3 days’ written notice, without further obligations beyond payment for hours worked.
10.4 Any significant change to the regular schedule (e.g. change in number of days or working hours) must be communicated to The Nanny Agency with at least 5 days' notice and requires written confirmation.
10.5 The Client must notify The Nanny Agency of any upcoming holidays or travel plans at least 7 days in advance. If the Client requires Childcare on Danish public holidays, a 50% holiday surcharge applies, subject to availability. The Babysitter is entitled to unpaid leave for public holidays unless otherwise agreed in writing.
10.6 The Babysitter may request unpaid time off for personal matters or illness with reasonable notice. The Nanny Agency will attempt to arrange a suitable replacement during this time if possible. The Client will not be charged if no Childcare is delivered.
11. Babysitter Assignment
